Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Infradev LLC, a company registered in Sharjah Media City Free Zone, United Arab Emirates, operating under the brand AIconsults and providing services under the name Safir ("Company," "we," "us," or "our").

By accessing or using the Safir mobile application, website (safir.aiconsults.io), or any related services (collectively, the "Service"), you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Services Description

Safir provides a technology platform that connects riders with independent drivers who provide transportation services. Key features include:

• Single Trips: On-demand transportation from point A to point B
• Hourly Hire: Book a driver and vehicle for a specified duration
• School Runs: Scheduled transportation services for school commutes
• Driver Preferences: Request specific drivers you have ridden with before

3. Eligibility

To use the Service, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable law
• Provide accurate and complete registration information

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

4. User Accounts

4.1 Account Creation

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. We are not liable for any loss or damage arising from your failure to protect your account information.

4.3 Account Verification

We may require verification of your identity, phone number, or other information. Providing false or misleading information may result in account suspension or termination.

5. Rider Terms

5.1 Requesting Rides

When you request a ride through Safir, you agree to:

• Provide accurate pickup and drop-off locations
• Be ready at the pickup location when the driver arrives
• Treat drivers with respect and courtesy
• Comply with all applicable laws during the ride
• Pay for services as described in Section 7

5.2 Ride Verification (OTP)

For your safety, rides are verified using a one-time password (OTP). You must:

• Share the OTP only with your assigned driver
• Verify the driver's identity before entering the vehicle
• Not share your OTP publicly or with unauthorized parties

5.3 Cancellation Policy

You may cancel a ride request before the driver arrives. Cancellation fees may apply as follows:

• Free cancellation within 2 minutes of request
• Cancellation fee applies after driver acceptance and approach
• No-show fee if driver waits beyond the grace period

5.4 Items Left in Vehicles

Safir is not responsible for items left in vehicles. We may assist in connecting you with the driver, but recovery is not guaranteed.

6. Driver Terms

6.1 Driver Requirements

To drive with Safir, you must:

• Be at least 21 years of age
• Possess a valid driver's license for your vehicle type
• Pass our vetting process, including in-person interview
• Provide valid insurance, registration, and inspection documents
• Maintain your vehicle in safe operating condition
• Comply with all local transportation laws and regulations

6.2 Independent Contractor Status

Drivers using the Safir platform are independent contractors, not employees. As such:

• You control when and where you drive
• You are responsible for your own taxes and expenses
• You may provide services through other platforms
• We do not provide employee benefits or protections

6.3 Driver Conduct

Drivers must:

• Provide safe and professional transportation
• Treat all riders with respect and courtesy
• Follow the most efficient route unless otherwise requested
• Maintain a clean and comfortable vehicle
• Not discriminate against riders
• Not engage in illegal activities

6.4 Driver Earnings

Drivers receive 85% of the ride fare. Payment terms and schedules are provided separately in the Driver Agreement.

7. Payment Terms

7.1 Fare Calculation

Fares are calculated based on:

• Distance traveled
• Time of ride
• Service type selected
• Applicable taxes and fees

You will see the estimated fare before confirming your ride request. The final fare may differ based on actual route, traffic, or rider-requested changes.

7.2 No Surge Pricing

Safir does not apply surge pricing or dynamic price multipliers. The fare estimate you receive is based on our standard rates.

7.3 Payment Methods

We accept payment through:

• Credit and debit cards
• CMI (Moroccan card payments)
• Wallet balance
• Cash (where available)

7.4 Receipts

Electronic receipts are sent to your registered email address after each completed ride.

7.5 Disputes

If you believe you were charged incorrectly, contact us within 30 days of the charge. We will investigate and process refunds for valid disputes.

8. User Conduct

You agree not to:

• Use the Service for any illegal purpose
• Harass, threaten, or discriminate against other users
• Provide false or misleading information
• Interfere with the proper functioning of the Service
• Attempt to gain unauthorized access to our systems
• Use automated means to access the Service without permission
• Resell or commercially exploit the Service
• Transport illegal substances or items
• Damage vehicles or property
• Engage in fraud or deceptive practices

Violation of these conduct rules may result in immediate suspension or termination of your account.

9. Safety

9.1 Our Safety Commitment

Safety is our priority. We:

• Personally vet all drivers through in-person interviews
• Conduct background checks on drivers
• Verify vehicle safety and documentation
• Provide OTP ride verification
• Enable real-time ride tracking
• Maintain emergency support capabilities

9.2 Reporting Safety Concerns

If you experience a safety issue, please report it immediately through the app or by contacting safety@aiconsults.io.

9.3 Insurance

Drivers are required to maintain valid vehicle insurance. Additional coverage details are provided in the Driver Agreement.

10. Intellectual Property

The Service and its contents, including but not limited to text, graphics, logos, icons, images, software, and trademarks, are the property of Infradev LLC or its licensors and are protected by intellectual property laws.

You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks without authorization
• Reverse engineer our software
• Remove any copyright or proprietary notices

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF INFORMATION
• UNINTERRUPTED OR ERROR-FREE SERVICE

We do not guarantee the availability, conduct, or quality of drivers or rides. Transportation services are provided by independent drivers, not by Safir.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INFRADEV LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES
• PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM YOUR USE OF THE SERVICE
• ANY CONDUCT OR CONTENT OF THIRD PARTIES

Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Infradev LLC and its affiliates from any claims, damages, losses, and expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of applicable laws

14. Dispute Resolution

14.1 Informal Resolution

Before initiating formal proceedings, you agree to contact us at legal@aiconsults.io to attempt informal resolution.

14.2 Arbitration

Any disputes that cannot be resolved informally shall be settled by binding arbitration in accordance with the rules of the Dubai International Arbitration Centre (DIAC). The arbitration shall take place in Dubai, UAE, and be conducted in English.

14.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

14.4 Governing Law

These Terms shall be governed by the laws of the United Arab Emirates, without regard to conflict of law principles.

15. Termination

15.1 By You

You may terminate your account at any time by contacting us or using the account deletion feature in the app.

15.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Pose a safety risk to users
• Fail to pay amounts owed
• Provide false information

15.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. Sections relating to intellectual property, disclaimers, liability, indemnification, and dispute resolution survive termination.

16. Modifications to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms on our website
• Sending you an email notification
• Displaying a notice in the app

Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Safir.

17.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

17.3 Waiver

Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

17.4 Assignment

You may not assign your rights under these Terms without our consent. We may assign our rights without restriction.

17.5 Force Majeure

We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control.
